ProPasser is the data controller for the personal information described in this policy. This means ProPasser decides why and how that information is used.
2. What this policy covers
This policy applies when you visit the website, submit an enquiry, contact ProPasser, book or receive driving tuition, make a payment, provide an emergency contact, agree to a test-pass photograph, or are captured by recording equipment used in connection with driving tuition.
3. Personal information we collect
- Contact and identity details: name, home address, postcode, email address and telephone number.
- Website enquiry details: information entered into the enquiry form, preferred reply methods and optional notes. Please do not include medical or other highly sensitive information in the website form.
- Driving and licence information: provisional driving-licence details, appropriate licence checks, lesson records, progress records, syllabus completion, driving-test information and test readiness.
- Emergency-contact information: the name, relationship and contact details of a person you nominate for use in an emergency. You should tell that person that you have provided their details to ProPasser.
- Communications: emails, WhatsApp messages, SMS messages, telephone notes and correspondence concerning enquiries, lessons, cancellations, payments, complaints or support.
- Payments and accounting: amounts paid, dates, lesson credits, refunds, bank-transfer references and accounting records. ProPasser does not collect payment-card details through the website.
- Photographs: test-pass or promotional photographs where the learner has expressly agreed to their use.
- Dashcam and in-car recordings: road-facing and in-car video, images, vehicle registration marks and audio. The in-car system records audio; learners are informed and reassured that recording is used for safety and the related purposes described below.
- Technical and security data: IP address, browser and device information, page requests, timestamps, security information, form metadata and spam-detection results processed by WordPress.com and Akismet.
ProPasser does not routinely collect dates of birth or medical information through the website. If information affecting safe tuition must be discussed, please contact ProPasser directly and provide only what is necessary.
4. How we obtain information
Most information comes directly from you when you submit a form, contact ProPasser, book tuition, attend lessons or make a payment. Information may also come from a parent or guardian, your nominated emergency contact, lesson and progress records, banking records, WordPress.com and Akismet, or dashcam and in-car recording equipment.
5. Why we use information and our lawful bases
- Enquiries: to respond and discuss requested tuition, relying on steps taken at your request before entering a contract and legitimate interests in responding to genuine enquiries.
- Lessons: to book, provide and manage tuition, relying on performance of a contract.
- Progress and test readiness: to provide structured, safe and effective tuition, relying on performance of a contract and legitimate interests.
- Payments, cancellations, credits and refunds: relying on performance of a contract.
- Tax and accounting records: relying on legal obligations.
- Emergency contacts: relying on legitimate interests in learner and instructor safety and, in a genuine emergency, protection of vital interests.
- Website security and spam prevention: relying on legitimate interests in maintaining a secure and reliable service.
- Dashcam, in-car video and audio: for safety, safeguarding, incident investigation, complaints, insurance and legal claims, relying on legitimate interests where recording is necessary and proportionate.
- Test-pass photographs: relying on consent, which may be withdrawn at any time.
- Rights requests, complaints and legal matters: relying on legal obligations and legitimate interests in establishing, exercising or defending legal claims.
ProPasser does not use enquiry details to send unrelated promotional emails or text messages. Contact will relate to your enquiry, requested tuition, existing lessons or necessary service administration.
6. Website forms and spam protection
The website is hosted on WordPress.com. When you submit the enquiry form, the response is processed and stored within WordPress.com Forms, checked automatically by Akismet for spam, and notified to ProPasser through Gmail. ProPasser may reply by email, WhatsApp, SMS or telephone according to the methods selected.
Do not use the form to send bank details, payment-card information, medical details or other highly sensitive information.
7. Who we share information with
We only share information where necessary. Recipients may include:
- Automattic/WordPress.com, which hosts the website, processes form responses and provides domain-email forwarding.
- Akismet, which checks form submissions for spam and abuse.
- Google/Gmail, which receives form notifications and may be used for correspondence.
- AOIT, which remains the registrar for the propasser.co.uk domain and may process domain-account and administrative details. AOIT does not receive website enquiry-form submissions.
- Meta/WhatsApp, where you choose to communicate through WhatsApp.
- Telephone and SMS network providers.
- ProPasser’s bank and payment providers for bank-transfer and accounting records.
- Insurers, professional advisers or legal representatives where necessary.
- Law-enforcement agencies, regulators, courts or public authorities where disclosure is required or permitted by law.
- Emergency services or your nominated emergency contact where necessary to protect safety.
ProPasser does not sell personal information.
8. International transfers
Some providers, including Automattic, Google and Meta, may process information outside the United Kingdom. Where UK personal information is transferred internationally, ProPasser will use providers that make an appropriate lawful safeguard available, such as UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, or another recognised safeguard.
9. How long we keep information
- Unsuccessful enquiries: up to 12 months after the last meaningful contact.
- WordPress form responses: up to 12 months where the enquiry does not lead to tuition. Necessary information may become part of the learner record when tuition is booked.
- Learner, lesson, progress and test records: during tuition and normally for up to six years after the last lesson where needed for contracts, complaints, insurance or legal claims.
- Provisional-licence details: while required for tuition and normally no longer than 12 months after tuition ends, unless connected to an incident, complaint, insurance or legal matter.
- Emergency contacts: while the learner is active and normally deleted within three months after tuition ends, unless needed in connection with an incident.
- Payment and tax records: for at least five years after the 31 January Self Assessment submission deadline for the relevant tax year, or longer where required.
- Routine dashcam, in-car video and audio: normally overwritten or deleted within 30 days. Material connected with an incident, complaint, insurance matter, safeguarding concern or legal claim may be retained until the matter and relevant retention requirement have ended.
- Test-pass photographs: until consent is withdrawn or the image is no longer needed, with publication reviewed periodically.
- Contractual or complaint correspondence: normally up to six years after the matter or tuition relationship ends.
Information may be kept longer where required by law, an insurer, regulator, court order or active legal claim, and may be deleted earlier where it is no longer needed.
10. Dashcams and in-car recording
ProPasser vehicles use recording systems for safety, safeguarding, incident investigation, complaints, insurance and legal purposes. The system records video and audio. Learners are warned that audio is active and are reassured that recording is for safety.
- Learners are informed that recording equipment is in use.
- Recordings are not used for unrelated purposes.
- Access is restricted.
- Routine recordings are overwritten or deleted in accordance with the retention period above.
- Relevant recordings may be disclosed lawfully to insurers, legal advisers, law-enforcement agencies or affected individuals.
- Reasonable steps are taken to protect the rights of other people captured.
Audio is more intrusive than video. ProPasser therefore limits access and use to the stated safety and related purposes and keeps the necessity and proportionality of audio recording under review.
11. Photographs and consent
Test-pass or promotional photographs are used only where the learner has agreed. ProPasser will explain where the photograph may appear, such as the website or social-media pages. Consent can be withdrawn at any time by emailing contact@propasser.co.uk. ProPasser will stop future use and remove material under its control within a reasonable period, although search-engine caches, third-party shares and printed material may not be immediately or fully within ProPasser’s control.
12. Security
ProPasser takes reasonable technical and organisational measures to protect information, including limiting access, using password-protected systems, securing devices and accounts, reviewing retained data and using established providers. No internet, email or storage system is completely secure, so please do not send sensitive information through ordinary email, WhatsApp, SMS or the website form unless it is necessary and an appropriate method has been agreed.
13. Your rights
Depending on the circumstances, you may have rights to be informed, request access, correct inaccurate information, request deletion, restrict processing, object to processing based on legitimate interests, receive certain information in a portable format, withdraw consent, and complain to the Information Commissioner’s Office. These rights are not absolute and an exemption may apply.
To exercise a right, email contact@propasser.co.uk. ProPasser may need to verify your identity and will normally respond within one month.
14. Complaints
Please contact ProPasser first so that we can try to resolve your concern. You also have the right to complain to the Information Commissioner’s Office or telephone 0303 123 1113.
15. Younger learners
Driving tuition may be provided to learners under 18. ProPasser will explain the use of personal information clearly and involve a parent or guardian where appropriate. The learner’s own data-protection rights still apply.
16. Automated decisions
ProPasser does not make decisions with legal or similarly significant effects using solely automated processing.
17. Changes to this policy
This policy will be reviewed when the website, services, recording practices or providers change. The latest version will be published at propasser.co.uk/privacy-policy/ with its updated date.
